HiServer Terms of Service (Last updated 2026-08-08)

These Terms of Service (the “Terms”) form a binding agreement between HiServer (“HiServer”, “we”, “us”, “our”) and the customer (“you”, “your”) for all services ordered through our website. By registering an account, placing an order, or using any of our services, you agree to these Terms, our Acceptable Use Policy, our Refund & Cancellation Policy, and our Privacy Policy, all of which are incorporated into these Terms by reference.

1. Definitions

  1. “HiServer”, “we”, “our” – the company providing the hosting, cloud-computing, dedicated-server, and colocation services offered on this website.
  2. “Client”, “user”, “you” – the individual or entity purchasing or using our services.
  3. “Services” – all dedicated-server, cloud-server, colocation, IP-address, and related products and services we offer.
  4. “Account” – the credentials and profile created after successful registration.
  5. “Acceptable Use Policy (AUP)” – the rules governing how clients may use our services, published at Acceptable Use Policy.

2. Account Registration & Responsibilities

  1. Registration accuracy. You must provide true, complete, and current information, and keep it up to date. Submitting false or misleading details may lead to suspension or termination.
  2. Age requirement. Users must be at least 18 years old.
  3. Account security. Keep login credentials confidential and notify us immediately of unauthorized access. We are not liable for losses resulting from compromised credentials.
  4. Verification. We may request reasonable identity or payment verification before activating or continuing to provide services, including for fraud-prevention purposes.

3. Services, Ordering & Provisioning

  1. Service descriptions. The specification, location, and price of each service are stated on the relevant product page at the time of order.
  2. Provisioning. Services are activated after payment is confirmed. Dedicated servers and custom configurations may require additional setup time, which we will communicate via the client area or support ticket.
  3. Service changes. We may upgrade, replace, or discontinue specific hardware or plans. If a discontinued plan affects your active service, we will offer a reasonable replacement or a pro-rated refund of the unused period.

4. Fees, Billing & Payment

  1. Prepayment. All services are prepaid on the billing cycle you select (monthly, quarterly, or annually) using the payment methods listed at checkout.
  2. Renewal invoices. Renewal invoices are generated approximately 14 days before the due date and are payable by the due date shown on the invoice.
  3. Late payment & suspension. If an invoice remains unpaid after its due date, the service may be suspended approximately 3 days after the due date and terminated approximately 7 days after the due date. Data on terminated services may be permanently deleted and cannot be recovered.
  4. Pricing changes. Price adjustments apply from your next renewal and will be visible on the renewal invoice; they never apply retroactively to a period you have already paid for.
  5. Taxes. Fees are exclusive of any applicable taxes, which are your responsibility unless stated otherwise on the invoice.

5. Refunds & Cancellation

  1. Refunds and cancellations are governed by our Refund & Cancellation Policy, which forms part of these Terms.
  2. You may request cancellation of any service at any time through the client area. Cancelling a service stops future billing; it does not by itself create a right to a refund except as described in the Refund & Cancellation Policy.
  3. Services terminated by us for violations of these Terms or the AUP are not eligible for refunds.

6. Acceptable Use

  • Your use of the Services is subject to our Acceptable Use Policy. In summary: no illegal content or activity, no spam or phishing, no network attacks or unauthorized access, no malware, and no resource abuse that degrades other clients’ experience.
  • Adult or gambling content requires prior written approval from HiServer.
  • Violations may lead to suspension or termination without refund; repeated offenses can result in a permanent ban.

7. Service Level Agreement (SLA)

  • We target 99.9% network uptime each calendar month.
  • Scheduled maintenance (announced in advance where practicable) and incidents outside our reasonable control are excluded from downtime calculations.
  • If network downtime exceeds 0.1% in any month, you may request a service credit equal to the pro-rated value of the affected downtime by opening a support ticket within 7 days of the incident. Service credits are applied to your account and are not paid in cash.

8. Data Ownership, Backups & Security

  1. Ownership. You retain ownership of all content stored on our servers, granting us only the rights necessary to host and transmit it.
  2. Backups. You are responsible for your own backups. While we may offer backup options, we do not guarantee full data recovery.
  3. Security. We employ industry-standard safeguards but cannot guarantee absolute protection against all threats. You must secure your own code, applications, and operating systems where you control them.

9. IP Address & Network Usage

  • All IP addresses remain the property of HiServer and must be relinquished upon service termination.
  • Using IP addresses for malicious, deceptive, or blacklisted activities is forbidden and may incur penalties, including recovery of the addresses.
  • Exceeding allocated bandwidth may trigger throttling or overage fees as described on the relevant product page.

10. Term, Renewal & Termination

  1. Term. Each service runs for the billing period you select and renews for successive periods of the same length when the renewal invoice is paid.
  2. Cancellation by you. You may cancel any time via the client area, effective immediately or at the end of the current billing period as you choose.
  3. Termination by us. We may suspend or terminate services for violations of these Terms or the AUP, non-payment, or activities threatening network integrity. Where practicable, we will give you notice and an opportunity to remedy the issue first.
  4. Effect of termination. Upon termination, your right to use the service ends and data stored on it may be deleted. Sections of these Terms that by their nature should survive (e.g., liability, indemnity) survive termination.

11. Disclaimer & Limitation of Liability

  • Except as expressly stated in these Terms, the Services are provided “as is” without warranties of any kind, whether express or implied.
  • We are not liable for indirect, incidental, or consequential damages, including loss of data, revenue, or business.
  • Our total liability arising out of or related to any service is limited to the fees paid by you for the affected service during the preceding billing cycle.
  • Nothing in these Terms excludes liability that cannot be excluded under applicable law.

12. Indemnification

  • You agree to indemnify and hold HiServer harmless from any third-party claims, damages, and reasonable costs (including legal fees) arising from your content, your use of the Services, or your breach of these Terms or the AUP.

13. Force Majeure

  • Neither party is liable for delay or failure to perform caused by events beyond its reasonable control, including natural disasters, war, labor disputes, government action, power or telecommunications failures, and attacks on network infrastructure. Payment obligations for services already delivered are not excused.

14. Governing Law & Disputes

  • These Terms are governed by the laws of the jurisdiction in which HiServer is registered, without regard to conflict-of-law rules. The parties will first attempt to resolve any dispute in good faith through our support channels before resorting to formal proceedings.

15. Changes to These Terms

  • We may update these Terms at any time. Significant changes will be announced via e-mail or on our website, and the “Last updated” date above will be revised.
  • Continued use of our services after changes take effect constitutes acceptance of the revised Terms.
